What is a Florida wrongful death claim?

There’s perhaps no greater loss or tragedy on this planet than the loss of a loved one. And unfortunately, they’re obviously not here to bring their own claim as a result of somebody’s negligence that led to their death. And so the Florida legislature passed a law that allows for wrongful death to be prosecuted as a personal injury claim, and it is a claim for the death of that loved one. And it legally has to be brought by a personal representative, somebody that’s designated by the court to bring that claim, and that claim is brought on behalf of survivors. Those are people defined under the statute that have the right to claim damages under the wrongful death statute, pertaining to the death of their loved one.
